Booking conditions

These conditions govern every booking made with BigBlue Surf Experience — accommodation, surf lessons, coworking, scooter rental and airport transfers. Please read them before you book. They exist to make what we owe you, and what you owe us, unambiguous.

1. Who you are contracting with

BigBlue Surf Experience is the brand under which three companies incorporated under Moroccan law operate together. Which of them you contract with depends on the service you book. This is set out below, and it is repeated at the point of sale for each service.

1.1 Accommodation, surf school, coworking, excursions, meals

Operated and sold by AUBERGE LESPOT S.A.R.L. (A.U.), trading as BigBlue Surf Experience. This includes BigBlue Hostel, BigBlue Surf Guesthouse, BigBlue Bay Studio, BigBlue Bay Duplex, BigBlue Surf School and BigBlue Coworking Space, which are trading names, not separate companies.

1.2 Scooter, bicycle and equipment rental

Operated and sold by BIGBLUE SCOOTERS RENTALS S.A.R.L. (A.U.), which holds its own fleet and its own vehicle insurance. Where you rent a scooter, a bicycle or equipment, your rental contract is with that company and is governed by its Conditions Générales de Location, summarised in section 9. Auberge Lespot S.A.R.L. (A.U.) acts as intermediary and collects payment in its name and on its behalf.

Where you book a transfer, your transport contract is with that company. Auberge Lespot S.A.R.L. (A.U.) acts as intermediary and collects payment in its name and on its behalf.

What this means for you in practice. You book once, you pay once, and you talk to one team — ours. Behind that, three companies each carry their own licences, their own insurance and their own responsibility for the service they deliver. Your point of contact for every service, including those operated by the other two companies, remains BigBlue Surf Experience.

1.4 Relationship between the three companies

The three companies are bound by a written partnership agreement governing the sale, the delivery and the settlement of each other’s services under the BigBlue Surf Experience brand. That agreement organises their relations with one another; it does not alter which company is liable to you, which is set out in section 13.

In these conditions, “we” and “BigBlue” mean the company responsible for the service concerned, as identified above.

By confirming a booking — on our website, through our booking engine, through a travel agency or online travel platform, by e-mail, by WhatsApp or at our reception — you accept these conditions on your own behalf and on behalf of every person named on the booking.

2. Services covered

These conditions apply to all of the following, whether booked individually, as an add-on, or as part of a package:

  • Accommodation at any of our four addresses in Taghazout
  • Surf lessons, surf coaching and surf guiding, and the rental of surf equipment
  • Coworking day passes and longer-term desk access
  • Scooter rental
  • Airport transfers and local transport
  • Excursions, activities, meals and wellness services sold by us

Where a package combines several of these, the general provisions in sections 3 to 5 and 11 to 16 apply to the package as a whole, and the service-specific provisions in sections 6 to 10 apply to each component.

Independent third-party providers. Certain excursions and activities are delivered by local providers outside our group. Where that is the case we say so before you book. We select those providers with care and remain your point of contact, but their own conditions govern the delivery of the activity itself.

2.2 Packages

Where a package combines services operated by more than one of the three companies, each company remains responsible for the service it delivers. The cancellation, modification and payment rules in sections 3 to 5 apply to the package as a whole and are administered by Auberge Lespot S.A.R.L. (A.U.) as the company that takes the booking.

3. Booking and confirmation

3.1 When a booking becomes binding

A booking is binding only once we have issued a written confirmation containing a booking reference. A request, a quotation or an unconfirmed reservation does not create a contract.

3.2 Availability

Some services — scooters, private coaching, certain excursions, and coworking during peak periods — are subject to availability and are confirmed separately. Where a booking is marked “on request”, it is not confirmed until we say so in writing.

3.3 Minimum age and minors

Guests under 18 must be accompanied by a parent or legal guardian, who accepts these conditions on their behalf and remains responsible for them throughout the stay. Surf lessons for minors require the express written consent of the parent or guardian.

3.4 Accuracy of your details

You are responsible for the accuracy of the names, dates, flight numbers and contact details you give us. Costs arising from incorrect information — a missed transfer, for example — are yours.

4. Prices, currency and payment

4.1 What is included

All applicable Moroccan taxes are included in our advertised rates. Tourist tax, where levied by the local authority, is stated separately at the point of sale where applicable.

4.2 Currency

Our reference currency is the Moroccan dirham (MAD). Where a price is displayed in euro, conversion is made at a fixed internal rate of MAD 11.00 = EUR 1.00. This rate is applied consistently to all conversions and is disclosed here so that you can compare it with the market rate before you book.

4.3 Payment methods and fees

Charges levied by your own bank — foreign transaction fees, its own exchange rate, cash withdrawal charges — are outside our control and remain yours.

We will never ask you for your card’s security code (CVV/CVC) by e-mail, WhatsApp, telephone or any other message. Nobody legitimately needs it outside a secure payment page. If you receive such a request claiming to come from us, do not respond and tell us immediately.

4.4 Guarantee of the booking

To hold a reservation we may require, depending on the rate booked: a card guarantee taken through the secure payment page of our booking engine, a pre-authorisation on that card, or a deposit. The method and amount are stated at the time of booking. Where a required guarantee is not provided within the time indicated in your confirmation, the booking may be released.

4.5 Balance

Unless your confirmation says otherwise, any balance is payable on arrival, before the service begins.

5. Cancellation, modification and no-show

A booking is treated as a no-show if you have not checked in, or presented yourself for the service, by 02:00 on the day following the scheduled start, without having told us.

Scooter, bicycle and equipment rentals follow their own cancellation rules, set out in section 9.7. Where a package includes a rental, that section applies to the rental component.

Non-refundable, promotional and group rates may carry stricter conditions. Where they do, this is stated clearly at the point of sale and those conditions prevail over this section.

5.2 Early departure and unused services

Departing earlier than booked, or not using a lesson, transfer, excursion or day pass that has been confirmed and held for you, does not give rise to a refund.

5.3 Modifications

Changes to a confirmed booking — dates, room type, package, number of guests, names — are subject to availability and to an administrative fee of EUR 15 per modification and per room. Requests must be made through our official channels and are effective only once we confirm them in writing. Where a modification cannot be accommodated, the original booking and its conditions stand.

5.4 Cancellation by us

We may cancel a booking where payment or a required guarantee has not been provided, where the booking was obtained by giving false information, where an activity cannot safely take place, or in the circumstances described in section 14. Where we cancel for a reason that is not attributable to you, you receive a full refund of the amounts paid for the cancelled service. That refund is the limit of our obligation.

6. Accommodation

Arriving after 18:00 is entirely normal and we accommodate late flights routinely — but tell us in advance by WhatsApp so that someone is expecting you.

6.2 Late check-out

Departure between 11:00 and 13:00 is charged at EUR 20 per hour started, capped at two hours. Departure after 13:00 is charged at EUR 50. Where a guest has exceeded the check-out time by more than two hours and cannot be reached, we may enter the room, store their belongings securely at reception, and prepare the room for the incoming guest. We do this to protect the arriving guest’s booking, and we take care of your belongings, but we cannot accept liability for the inconvenience this causes.

6.3 What is included

  • Breakfast is included. Lunch and dinner are available at extra cost.
  • Wi-Fi at standard speed is included and is suitable for messaging, browsing and e-mail. A High-Speed Internet Pass (up to 200 Mbps) is available daily, weekly or monthly. Access vouchers are personal and non-transferable.
  • Hammam, laundry, activities and excursions are not included unless your package says so.
  • Airport transfer is included from five nights on packaged trips; otherwise it is bookable separately.

6.4 Room allocation

We allocate specific rooms and beds according to the category booked. We cannot guarantee a particular room number, floor, view or bed position unless it forms part of the category you paid for. In shared dormitories, a bed is booked — not the room.

6.5 Access at night

The property closes at 03:00 for the security of everyone staying. If you expect to return later, tell us beforehand by WhatsApp and we will arrange access. Turning up unannounced after closing may mean waiting.

7. Surf school and coaching

Surfing is a sport practised in a natural environment that changes hour by hour. It carries inherent risks that cannot be eliminated — waves, current, seabed, other water users, and the equipment itself. By booking a lesson, a guided session or equipment, you accept those risks knowingly.

7.1 Your declaration

By booking any surf service you confirm that you are in adequate physical health to take part, that you are able to swim, and that you have disclosed to us in writing any medical condition, injury, allergy, medication or pregnancy relevant to physical activity in the sea. We may refuse participation, or end a session, where a participant’s condition makes it unsafe. No refund is due in that case if the condition was not disclosed.

7.2 Instructor authority

Our instructors decide the spot, the level of the group, the duration and whether a session takes place at all. Their instructions must be followed at all times, in and out of the water. A participant who disregards a safety instruction, or who enters the water under the influence of alcohol or drugs, may be removed from the session without refund.

7.3 Conditions, substitution and cancellation

Surf times follow the tide, not the clock, and the daily programme is set the evening before. Where the sea, the wind or the swell make a session unsafe, we will move it to another time or another spot, or replace it with an equivalent activity. Where no substitution is possible within your stay, the session is refunded or credited. A change of spot or of time is not a cancellation.

7.4 Levels and groups

Groups are formed by level. We reserve the right to move a participant to a different group where their actual level differs from the one declared, in the interest of their safety and of the group.

7.5 Equipment

Boards, wetsuits and leashes are provided in working condition and remain our property. You are responsible for the equipment issued to you from the moment you receive it until you return it. Loss or damage beyond normal wear is chargeable at replacement or repair cost. Equipment must not be lent, sold or taken away from the agreed area of use.

7.6 Personal insurance

We hold the civil liability insurance required of us under Moroccan law. That cover does not extend to your own injury, illness, medical repatriation, or loss of your belongings. Personal travel insurance covering water sports is strongly recommended and is your responsibility.

8. Coworking space

8.1 Access and opening hours

The personal access code is strictly individual. It must not be shared, and it is deactivated at check-out. Sharing it is a breach of these conditions and may result in access being withdrawn without refund.

Access is sold as a day pass, valid for the calendar day of use. Passes are personal and non-transferable. Longer access is included in the Stay & Work package. We do not sell weekly or monthly passes.

Desks are unallocated; call booths are shared and used on a first-come basis.

8.2 Connectivity

We provide fibre internet and maintain it actively. We cannot, however, guarantee uninterrupted service: outages caused by the national operator, the electricity grid or force majeure are outside our control. Where an outage lasts more than half a working day, we will credit the affected day.

8.3 Conduct

The main room is a quiet working area. Calls and video meetings belong in the call booths. Members are asked to keep the space usable for everyone: no reserving desks in absence, no leaving belongings unattended overnight.

8.4 Your equipment

Lockers are available. Laptops and personal equipment remain under your responsibility at all times and are not insured by us.

9. Scooter, bicycle and equipment rental

Operated by BigBlue Scooters Rentals S.A.R.L. (A.U.). Your rental contract is with that company and is governed by its Conditions Générales de Location, of which this section is a faithful summary. In case of divergence, the French original prevails.

Riding a scooter in Morocco carries real risk. Road conditions, driving habits and animal crossings differ from what you may be used to. Ride defensively and within your ability.

9.1 When the rental contract is formed

Under Articles 2 and 230 of the Moroccan Code of Obligations and Contracts, the rental is only effective once all of the following are complete: the individual contract is signed, the general conditions are accepted, the rental price is paid, the deposit is paid, and your documents are validated.

9.2 Who may rent

  • Minimum age 18.
  • A valid driving licence for the category concerned — required in particular for engines above 50 cm³. An international driving permit may be required of foreign nationals.
  • A valid identity document: passport for foreign nationals, CIN for Moroccan residents.
  • Being physically, mentally and medically fit to ride, with no suspension or withdrawal of licence.

The renter may refuse a rental at its discretion, without having to give a reason. Where a rental is refused after booking, the cancellation rules in 9.7 apply.

9.3 Security held against the rental

Rentals are secured the same way as every other BigBlue product: a pre-authorisation on the payment card of the person named on the booking. No money leaves your account, and nothing is charged unless something is damaged, lost or left unpaid.

The hold secures damage, theft, loss, traffic fines, unpaid sums and administrative costs. Where the loss exceeds the amount held, the balance remains due.

Section 11 carries the amounts, explains how a hold works, and says what happens where your card does not support one.

9.4 Payment

Payment in full is required before the vehicle is handed over. Accepted: cash in MAD, EUR, USD, GBP or CHF; instant bank transfer; foreign payment card with a 5% fee. Conversions use the renter’s internal annual average rate.

9.5 Condition, use and prohibitions

A joint inspection is carried out at collection and at return. Absent a written reservation at collection, the equipment is deemed received in perfect condition (Article 627 DOC). Current upkeep during the rental is the renter’s responsibility.

You undertake to ride with care, to comply with the Highway Code, and to wear an approved helmet. The following are strictly prohibited and terminate the contract immediately, without refund:

  • Lending, subletting or transferring the vehicle to anyone else
  • Leaving the authorised area without prior agreement
  • Any professional or commercial use, and any participation in a race
  • Transporting dangerous goods
  • Modifying or transforming the equipment
  • Riding under the influence of alcohol, drugs or prohibited substances

Traffic fines, penalties and impound costs incurred during the rental are yours, including where they reach us after your departure.

9.6 Insurance — read this carefully

Vehicles carry the compulsory third-party liability insurance required by Moroccan law. The following are excluded from all cover:

  • Bodily injury to the rider
  • Theft of the vehicle
  • Material damage to the vehicle
  • Damage resulting from negligence or misuse

Under Articles 77, 78 and 264 DOC, the renter alone bears those risks and is solely liable for damage caused to third parties, to property and to themselves. Personal travel insurance covering the use of a two-wheeler is strongly recommended and is your responsibility.

9.7 Cancellation of a rental

Cancellation and modification requests must be made in writing — official WhatsApp, e-mail or online form. Verbal requests are not accepted. Modifications are subject to availability and to prior agreement, and are never guaranteed.

The renter may cancel for non-payment, non-compliant documents, suspected fraud, a safety concern, force majeure or unforeseen technical unavailability; sums paid are then refunded, with no further compensation.

Force majeure is governed by Article 269 DOC. In such a case the renter may offer, at its discretion, a postponement, a credit or a partial refund; no further compensation may be claimed.

9.8 Accidents

In case of accident or incident you must immediately inform the renter, contact the authorities, complete an accident report (constat), and provide photographs and witness details. Failure to do so voids cover and leaves you carrying the full financial consequences.

9.9 Complaints

Complaints relating to a rental must be made in writing within 48 hours. After that period they are not admissible. This is shorter than the period in section 16.2, which applies to the other services.

10. Airport transfers

Operated by Mamoune Travels S.A.R.L. (A.U.), licensed passenger transport. Your transport contract is with that company.

10.1 Information you must give us

We need your flight number, arrival time and terminal at least 48 hours before landing. Without it we cannot guarantee a driver.

10.2 Waiting time

Our driver waits up to 60 minutes after the actual landing time, free of charge. Beyond that, waiting is chargeable, and after 90 minutes without contact the transfer is treated as a no-show.

10.3 Flight delays and cancellations

We track flights and adjust for delays at no extra cost where we have your flight number. Where your flight is cancelled or diverted, tell us as soon as you know; we will rebook the transfer for the new arrival at no charge where operationally possible.

10.4 Departure transfers

Pick-up times are set by us based on the airport, traffic and your flight. Requesting a later departure than we advise is at your own risk.

10.5 Luggage

Standard allowance is one suitcase and one item of hand luggage per person. Surfboards, bulky sports equipment and additional bags must be declared at booking so that we can send an appropriate vehicle.

11. Security: card pre-authorisation

One regime covers all our services and products: accommodation, scooter rental, and skate and surf equipment rental. Security is taken as a pre-authorisation on the payment card of the person named on the booking. A cash deposit is taken only where no card is available, and 11.4 says how that one is returned.

The amount that applies to your booking is stated on the product page before you pay, and again on your confirmation.

11.2 How a hold works

A pre-authorisation is a temporary hold. No money leaves your account. Your bank simply reserves the amount against your available balance, and the hold is released when we tell them to.

11.3 Card requirements

The card must be valid for the whole stay and carry sufficient available balance for the hold. Some prepaid cards and certain digital wallets do not support pre-authorisation. Where yours does not, tell us before arrival so that we can prepare the alternative set out below.

11.4 Where no card is available

Where you cannot provide a card that supports a pre-authorisation, the same amount is taken as a cash deposit: at check-in for accommodation, at collection for a rental. You receive a written receipt stating the amount, the date and what it secures.

The deposit is returned once the room, the vehicle or the equipment has been checked, by one of two routes:

  • In cash at reception, on the spot, where the check is made during reception opening hours, 08:00 to 18:00.
  • By bank transfer, where you leave outside those hours. We take your bank details in writing and order the transfer as soon as we have them.

A transfer normally reaches your account within 10 working days, and sometimes takes longer. That delay belongs to the banks: it depends on your own bank, on any intermediary bank on the route, and on public holidays in Morocco and in the destination country. Where nothing has arrived after 10 working days, write to us and we will send you the proof of transfer to take to your bank.

Leaving outside reception hours is what turns a same-day cash refund into a transfer. Where your departure falls outside 08:00 to 18:00, tell reception the day before and we will settle the deposit while the desk is open.

11.5 If there is damage

Where damage, loss or a breach of house rules is found, we will tell you in writing, with photographs and a costing, before capturing any amount. You have the opportunity to respond. Only then, and only up to the amount actually assessed, is the hold converted into a charge; the balance of the hold is released.

Where the security was taken in cash, the same rule applies: the amount assessed is deducted from the sum returned to you, and the balance is refunded by the route set out in 11.4.

Where the cost exceeds the amount held, the difference remains due. Where you dispute the assessment, section 16 applies.

A pre-authorisation is a guarantee, not a payment, and the same is true of a cash deposit. Neither is a cancellation fee, neither can be applied against the price of your stay, and neither is captured or retained without prior written notice to you.

12. House rules and conduct

  • Respect for the village. Taghazout is a working fishing village, not a resort. Dress and behave in public with that in mind.
  • Quiet hours apply from 23:00 in the accommodation areas.
  • No illegal substances on the property, under any circumstances.
  • Smoking is permitted only in designated outdoor areas.
  • Visitors who are not registered guests may not access the accommodation areas without our agreement, for the security of everyone staying.
  • Identity and civil status. Moroccan law requires us to register every guest and to record an identity document for each person staying. In addition, and in accordance with Article 490 of the Moroccan Penal Code, Moroccan and Muslim couples sharing a room are required to present a valid marriage certificate (acte de mariage) at check-in. Where it is not produced, we are unable to provide shared accommodation; the booking is then treated under section 5.1 and no refund is due.
    This provision does not apply to non-Moroccan, non-Muslim visitors, who are not required to present any document of this kind.
  • Registration. Moroccan law requires us to register every guest and to record the identity document of each person staying. This is not optional.

Serious or repeated breach of these rules, behaviour that endangers others, or harassment of guests or staff, entitles us to end the stay immediately without refund. We do not take that step lightly and it is rare.

13. Insurance and liability

13.1 Each company answers for its own service

Each of the three companies named in section 1 carries its own insurance and is liable for the service it delivers, to the exclusion of the others:

A claim relating to a transfer is directed to Mamoune Travels S.A.R.L. (A.U.); a claim relating to a scooter to BigBlue Scooters Rentals S.A.R.L. (A.U.). In both cases you may raise it with us and we will pass it on, but the liability itself is theirs and not that of Auberge Lespot S.A.R.L. (A.U.).

13.2 What is not covered

The company concerned is liable for damage caused by its own proven fault or that of its staff. None of the three companies is liable for:

  • valuables not deposited in the safe or locker made available to you;
  • injury, illness or loss resulting from your own act, from disregard of a safety instruction, or from the inherent risks of the activities described in sections 7 and 9;
  • services delivered by independent third-party providers outside the group, beyond our duty to select them with care;
  • indirect or consequential loss, including missed flights, missed connections and loss of earnings.

Except in cases of gross negligence or wilful misconduct, the total liability of the company concerned in respect of a booking is limited to the amount you paid for the service it delivered.

We strongly recommend comprehensive travel insurance covering medical care, repatriation, cancellation, personal belongings and water sports. We cannot substitute for it.

14. Force majeure

Neither party is liable for failure to perform caused by an event beyond its reasonable control: extreme weather, natural disaster, epidemic, government decision, border or airport closure, strike, civil unrest, or interruption of water, electricity or telecommunications networks.

Where such an event prevents a service from being delivered, we will offer a postponement or a credit valid for eighteen months. Where neither is possible, we refund the amounts paid for the services not delivered, less any sums already irrecoverably committed to third-party suppliers on your behalf.

15. Personal data

We process your personal data in accordance with Moroccan Law No. 09-08 on the protection of individuals with regard to the processing of personal data, under the supervision of the CNDP, and — for guests resident in the European Union — in accordance with the GDPR. Full details, including your rights and how to exercise them, are set out in our Privacy Policy. Where your booking includes a scooter or a transfer, the data strictly necessary to deliver it is shared with the company concerned, which processes it as controller for that service.

16. Complaints and governing law

16.1 Tell us while you are here

If something is wrong, tell reception or write to us on WhatsApp during your stay. Almost everything can be fixed on the spot; almost nothing can be fixed once you have flown home. We ask that you give us that opportunity before escalating.

16.2 Formal complaints

Written complaints should be sent to management@bigbluesurfexperience.com or through our contact form within 30 days of departure, with your booking reference. We acknowledge within 5 working days and answer within 30 days.

16.3 Governing law and jurisdiction

These conditions are governed by Moroccan law, in particular Law No. 80-14 on tourist establishments and other forms of tourist accommodation, Law No. 31-08 on consumer protection measures, and the Moroccan Code of Obligations and Contracts.

The parties will seek an amicable settlement of any dispute. Failing that, and irrespective of which of the three companies is concerned, the courts of Agadir have jurisdiction, without prejudice to any mandatory protection available to consumers under the law of their country of residence.

16.4 Language

These conditions are published in English. Translations are provided for convenience; in case of divergence, the English version prevails, save where mandatory local law provides otherwise.

Exception. The Conditions Générales de Location of BigBlue Scooters Rentals S.A.R.L. (A.U.), summarised in section 9, are drafted in French and the French version is the legally binding one for rentals.

16.5 Severability and amendment

If any provision is held invalid, the remainder stands. We may amend these conditions; the version in force on the date of your booking is the one that applies to it, and it is the version we will send you with your confirmation on request.
